Legality is used as an adjective of a fact or legal act when it is considered in accordance with current law and in turn is considered morally and ethically a just act.

They can only have as legal adjective the facts or acts carried out by people. This since a fact of nature, such as a natural catastrophe, cannot be considered either legal or illegal.

An example of a lawful fact is parking in an area designated for it. It is allowed by local regulations and in turn it is fair that you park in the area designated for it.

In contract law, an essential requirement for the validity of a contract or obligation is that it has a lawful purpose. What does it mean? That the matter on which you want to contract is in accordance with the law and morals.

The use of the legal object in legal acts is also common.Which means that all legal businesses must comply with current regulations without exceeding the limits established therein and must meet certain requirements:

  • It cannot be an impossible fact.
  • Nor can it violate fundamental rights.
  • It cannot be contrary to the current law.
  • Nor can it be contrary to custom.

All legal acts that fail to comply with these requirements will be considered illegal acts and therefore the legal act or business will be null and void. This means that it will not have any validity and has never had it (nullifying the effects that it could have had).

Differences between lawful / legitimate / legal

It is common to confuse the terms lawful, legitimate and legal, but here we are going to differentiate them.

Something is legal when it is in accordance with current regulations without any kind of moral consideration.

It is considered legitimate when it is consistent with morals and ethics but does not necessarily have to be included in a written standard.

Finally, something is legal when, in addition to being in accordance with a written law, it has moral acceptance.


On the contrary, we find the illegal acts that are those that are prohibited in the norm and also have a negative moral and ethical evaluation.
