A property registrar is a professional whose main function is the registration, annotation and publication of facts related to real estate and its related rights.
The institution in which a property registrar carries out its work is the Land Registry. This organization is public in nature and is responsible for the creation of public ownership of real estate based on a public authority.
In the same way, this institution is in charge of publicizing and informing the public about the different situations of the real estate.
The registrar is therefore the link between the public entity and the private demand for property registration and advertising.
That is to say, it performs in practice the main missions of the Registry: registration of constitutions, any modification of the real rights of a specific property and other documentation related to leases.
Due to the existence of a large number of facts that can be registered in the day-to-day life of any territory, the registries have been responding to this demand with the preparation and training of more professional registrars.
Access to these positions is usually done through public competitions.
Main functions of the property registrar
A property registrar has a series of tasks to highlight and that make up the bulk of his work as a public official:
- Registration or annotation of any fact or act related to the life of a real estate in its corresponding district.
- Grant legal and public validity to multiple types of documents that affect the property. An example would be a contract for the sale or sale of a farm.
- Terminate contractual relationships in cases of expropriations of assets, for example, by seizures.
- It not only publicly reflects relevant facts that affect houses, plots, land or buildings of all kinds, but also the mortgage obligations that these assets may have. That is, it also mediates in cases of surrogacy or bank novation.
On the other hand, it is convenient to add that the organization of the registry is markedly territorial.
In other words, a registrar usually deals with relevant facts related to properties located or registered in the same geographical area or territorial delimitation. They are called constituencies or mortgage districts.
Alternatively, the mode of organization of the registrars is established through a collegiate form, as is the case with other professional associations such as law or medicine. In the case of Spain, the College of Property, Mercantile and Movable Property Registrars would exist as an institution.
